Terms and Conditions

Introduction

  1. Tampa Bay Test Prep LLC (d/b/a “The Math Gift”) is an active business in the State of Florida.
  2. Throughout this document, “We” and “Our” refer to Tampa Bay Test Prep, its staff, and its employees. “You” and “Your” refer to the client reading this or receiving our services.
  3. Tampa Bay Test Prep reserves the right, in its sole discretion, to change these Terms, in whole or in part, at any time. Changes in these Terms will be effective when posted.

Confidentiality

  1. We agree not to provide your information to a third party under any circumstance not authorized by the law or by you.
  2. You understand that all course materials and methods are the exclusive property of Tampa Bay Test Prep. You agree not to disclose, reproduce, sell, or otherwise distribute any information obtained from Tampa Bay Test Prep.

Tutors

  1. All of our tutors are legally authorized to work in the United States. Our recruitment process is thorough and ensures that only high-quality tutors are employed. We accept no liability for any grievances that occur in a tutoring session.
  2. If you are not happy with the tutor we have assigned to you, please contact Tampa Bay Test Prep before your second tutoring session. We will assign a new tutor and not charge you for your first session with your original tutor. If you request a change in the tutor assigned to you after your second tutoring session, we will charge you for all hours used.

Cancellations/Missed Appointments/Tardiness

  1. Sessions are expected to start and end as scheduled regardless of the time your student ls on. No adjustment to fees shall be made for time lost due to tardiness or the need to leave early.
  2. We send confirmation emails, and reminder emails, and reminder texts to students for every appointment. We will not be held responsible for any student who forgets to attend class.
  3. If you need to cancel a scheduled tutoring session, please cancel at least 48 hours in advance of the session. If you fail to give 24 hours’ advance notice of any cancellation, the missed session will be billed 100%. Please contact us at support@tampabaytestprep.com
    1. Cancel your appointment online through TutorCruncher.
    2. Give your tutor notice via email, text, or phone call, or
    3. Contact Tampa Bay Test Prep at or 813-778-5255 
  4. A parent must be present for the duration of an in-home tutoring session. If a parent isn’t present at the beginning of an in-home tutoring session, the session will be canceled and treated as a no-show.

Payment

  1. You agree to pay Tampa Bay Test Prep the agreed-upon package or hourly rate for services. You understand that you will be charged for time in fifteen-minute increments. You can pay by credit card online via Tutorcruncher.
  2. Tampa Bay Test Prep may permanently cancel your services if you have not paid for your first session (as part of a discounted package or an individual session payment) by your second scheduled session or if you do not comply with these Terms or other rules and procedures applicable to our services being provided to you.
  3. Prepaid packages are only valid for future sessions. Prepaid packages cannot be applied to past unpaid sessions.
  4. Payment is due at the date of service. Your credit card on file may be charged for any fees more than 30 days past due. Your credit card on file may also be charged for missed sessions and sessions not canceled 24 hours in advance. These transactions may occur without additional notice. Fee payment deadlines are your responsibility. You may be charged a penalty fee if your credit card company denies your credit card.

Refunds

  1. If, after your first session, you are not totally satisfied, we will make every attempt to find you a new tutor. If we are unable to find a suitable replacement within a reasonable amount of time, we will refund any pre-paid sessions you have remaining.
  2. Except in the above situation, you agree that at no time will you be eligible for a refund for services to be provided by Tampa Bay  Test Prep. This no refund policy is absolute.

Guarantees

  1. You agree not to hold Tampa Bay  Test Prep liable for any failed tests, low scores in math competitions, or denied admissions from any educational institution.
  2. We do not guarantee any specific outcomes as a result of tutoring or counseling (admission to any educational institution or test score improvements). We will provide services to help you succeed, but the rest depends on you.

Discontinuation

  1. We reserve the right to discontinue service at any time for any reason.
  2. We may cancel your services if you are, in Tampa Bay Test Prep’s opinion, disruptive in your program or do not comply with these Terms or other rules and procedures applicable to our services being provided to you.

Disputes

  1. Any disputes, claims, or actions arising out of these Terms or any other services of Tampa Bay Test Prep shall be governed by the laws of the State of Florida. Any dispute must be settled by court-ordered mediation and must take place in the State of Florida.
  2. You agree to submit to personal jurisdiction in the Florida courts to resolve any such dispute. In the event of litigation relating to the subject matter of these Terms, the non-prevailing party shall reimburse the prevailing party for all reasonable attorney fees and costs resulting.
